Consent Overview

When you provide your phone number and opt in, you agree to receive text messages from Ferni to support your coaching journey.

Agreement

By providing your mobile phone number and opting in to SMS communications:

  • You consent to receive autodialed, recurring text messages from Ferni AI, Inc.
  • You confirm you are the account holder or authorized user of the phone number
  • You agree to these SMS Terms & Consent
  • You acknowledge that consent is not a condition of purchase

What You're Consenting To

By opting in, you expressly consent to receive:

Automated Text Messages

  • Messages sent using automated technology
  • Recurring messages at the frequency described below
  • Messages to the mobile phone number you provided

Message Categories

  • Marketing messages from third parties

Coaching Reminders

"Hey! Ready for your check-in with Maya? She's been thinking about your morning routine progress."

Gentle nudges to reconnect with your coaching sessions. These help you stay on track with your personal development goals.

Personalized Check-Ins

"How did that conversation with your manager go yesterday? We're here if you want to talk through it."

Follow-ups on topics from your recent sessions. Our team remembers what matters to you and checks in at meaningful moments.

Habit Tracking Nudges

"Day 7 of your meditation streak! That's a full week. How's it feeling?"

Encouragement for the habits you're building. Celebrate milestones and get gentle reminders to keep going.

Account Notifications

"Your Ferni subscription renews in 3 days. Questions? Reply or call us."

Important updates about your account, billing, and service changes. These are informational, not promotional.

Verification & Security

"Your Ferni verification code is 482953. This expires in 10 minutes."

One-time codes for account verification and security. These may be sent even if you've opted out of other messages.

Message Personalization

Messages are personalized based on:

  • Your conversation history and goals
  • The AI coaching persona you're working with
  • Your time zone and preferences
  • Your recent activity and progress

Quiet Hours

We respect your time and will not send messages:

  • Between 9:00 PM and 8:00 AM in your local time zone
  • During major holidays (unless you've enabled critical notifications)
Exception: Verification codes and urgent security alerts may be sent outside quiet hours when you've initiated an action requiring immediate confirmation.

Frequency Variations

Message frequency may vary based on:

  • Active coaching periods: More check-ins when you're actively engaged
  • Goal milestones: Celebratory messages when you hit targets
  • Low activity: Fewer messages if you haven't engaged recently
  • Your preferences: Adjustable in account settings

Adjusting Frequency

You can control message frequency:

  • In the app: Settings → Notifications → SMS Preferences
  • By email: Contact support@ferni.ai
  • Complete opt-out: Reply STOP to any message

Costs & Carriers

Your Costs

Message and data rates may apply.

Standard text messaging rates from your mobile carrier will apply to all messages you receive from Ferni. Check with your carrier for details about your messaging plan.

What Ferni Charges

Ferni does not charge separately for SMS messages. Text messaging is included as part of your Ferni service. However, your mobile carrier may charge you based on your plan.

International Numbers

Currently, Ferni SMS is only available for U.S. mobile phone numbers. International messaging may be available in the future.

Delivery Issues

If you're not receiving messages:

  • Verify your phone number in account settings
  • Check that you haven't blocked our number
  • Ensure you have SMS enabled with your carrier
  • Contact us at support@ferni.ai

How to Opt Out

Text STOP to cancel anytime.

Reply STOP to any Ferni message to immediately unsubscribe from all SMS communications. You'll receive a confirmation message, and we won't text you again unless you opt back in.

Other Ways to Opt Out

  • In-App: Settings → Notifications → Disable SMS
  • Email: Send "Opt out of SMS" to support@ferni.ai
  • Phone: Call 1 (888) 598-3952

What Happens After Opting Out

  • You'll receive a confirmation: "You've been unsubscribed from Ferni SMS. Reply START to re-subscribe."
  • All coaching, reminder, and notification messages will stop
  • You may still receive transactional messages (verification codes) if you initiate them
  • Your Ferni account remains active—only SMS is disabled
  • Your phone number remains on file (for account association) until you request deletion

Processing Time

Opt-out requests are processed immediately. In rare cases, you may receive one additional message that was already in our sending queue before your request was processed.

How to Opt In

Initial Opt-In

You can opt in to Ferni SMS by:

  • During signup: Provide your mobile number and check "Send me text messages"
  • In-App: Settings → Notifications → Enable SMS
  • By request: Contact support@ferni.ai

Re-Subscribing After Opt-Out

If you previously opted out and want to receive messages again:

Double Opt-In

When you opt in, we may send a confirmation message asking you to reply YES to confirm. This ensures:

  • You intended to opt in
  • You have access to the phone number
  • We have proper consent on file

Consent Records

We maintain records of your consent including:

  • Date and time of opt-in
  • Method of opt-in (web form, text, in-app)
  • IP address (if applicable)
  • Consent language shown at time of opt-in

Your Data & Privacy

Phone Number Protection

We take your privacy seriously:

  • Never sold: We never sell, rent, or share your phone number with third parties for their marketing
  • Encrypted: Your phone number is encrypted at rest and in transit
  • Access limited: Only authorized systems and personnel can access your number
  • Retained only as needed: Your number is retained only as long as your account is active

How We Use Your Phone Number

Account Association Link your phone to your Ferni account

Service Providers

We use the following providers to deliver SMS messages:

  • Twilio: SMS infrastructure and delivery
  • Mobile carriers: Final delivery to your device

These providers process your phone number only for message delivery and are contractually bound to protect your data.

Deleting Your Phone Number

You can request complete deletion of your phone number by:

  • Removing it in Settings → Account → Phone Number
  • Requesting deletion via privacy@ferni.ai
  • Deleting your entire Ferni account

Your TCPA Rights

The Telephone Consumer Protection Act (TCPA) gives you important rights regarding text messages. Here's what you should know:

Your Rights Under TCPA

  • Prior express consent required: We cannot send you automated text messages without your consent
  • Right to revoke: You can revoke consent at any time by any reasonable means (texting STOP, calling us, emailing us)
  • No consent required for purchase: We cannot require SMS consent as a condition of purchasing our services
  • Clear disclosure: We must clearly disclose the nature of messages before you opt in

Our Compliance

Ferni is committed to TCPA compliance. We:

  • Only send messages to numbers that have opted in
  • Honor all opt-out requests promptly
  • Maintain records of consent
  • Include opt-out instructions in messages
  • Identify ourselves in all messages
  • Respect the National Do-Not-Call Registry

Exemptions

Certain messages may be sent even after you opt out:

  • One-time password (OTP) verification codes you've requested
  • Responses to messages you initiate
  • Important security alerts about your account

Filing Complaints

If you believe your TCPA rights have been violated, you may:

  • File a complaint with the FCC at consumercomplaints.fcc.gov
  • File a complaint with the FTC at reportfraud.ftc.gov

Troubleshooting

Not Receiving Messages

Number blocked on your phone Check blocked numbers in your phone settings
Carrier blocking Contact your carrier or us for help

Receiving Too Many Messages

  • Adjust frequency: Settings → Notifications → SMS Frequency
  • Reduce categories: Disable specific message types you don't want
  • Opt out temporarily: Text STOP, then START when ready
  • Contact support: We can customize your preferences

Messages Arriving Late

SMS messages may be delayed due to:

  • Carrier network congestion
  • Poor signal at time of sending
  • Phone being off or in airplane mode
  • Carrier maintenance windows

STOP/HELP Not Working

If SMS keywords aren't working:

  • Ensure you're replying to a Ferni message (not a new text)
  • Check that your message contains only the keyword (no extra text)
  • Wait 1-2 minutes and try again
  • Contact us directly at support@ferni.ai
